These General Terms and Conditions apply to all offers, quotations, orders, and agreements with GolfJoy Europe B.V. (“the Supplier”), unless explicitly agreed otherwise in writing. By using this website, placing an order, or purchasing services from GolfJoy Europe B.V., the Client acknowledges that he/she has read, understood, and accepted these General Terms and Conditions.
2.1 These General Terms and Conditions apply to all products, services, offers, and agreements of the Supplier.
2.2 Deviations from these General Terms and Conditions are only valid if confirmed in writing by the Supplier.
2.3 The applicability of any conditions of the Client is expressly rejected.
3.1 All prices are stated in the currency displayed on the website at the time of the order, including or excluding VAT as indicated.
3.2 Payment must be made in full at the time of ordering, unless otherwise agreed in writing.
3.3 In case of late payment (if applicable), the Supplier reserves the right to suspend the Agreement and charge statutory interest and reasonable collection costs.
4.1 Delivery times as stated on the website or in the order confirmation are indicative and not binding, unless explicitly stated otherwise.
4.2 The Supplier’s Shipping Policy forms an integral part of these General Terms and Conditions
4.3 The risk of loss passes to the Client as soon as the goods have been handed over to the carrier.
5.1 Returns and refunds are governed by the Supplier’s Return Policy.
5.2 The Client is responsible for following the return instructions as described in that policy.
5.3 The Supplier reserves the right to refuse returned goods that do not comply with the Supplier’s return conditions.
6.1 The Client may cancel the Agreement by written notice to the Supplier.
6.2 In case of cancellation, the Supplier is entitled to charge a cancellation fee of 25% of the total contract value to cover administrative costs, planning, and reserved capacity.
6.3 Any costs already incurred or work already performed at the time of cancellation may be charged in addition to the cancellation fee.
7.1 The Supplier may cancel or modify the Agreement if circumstances arise that prevent proper fulfillment, including force majeure or disruptions in the supply chain.
7.2 In such cases, the Supplier shall inform the Client as soon as reasonably possible and refund any payments for goods or services not yet delivered.
8.1 The Supplier’s liability is limited to the maximum amount paid by the Client under the Agreement.
8.2 The Supplier is not liable for indirect or consequential damages, including but not limited to lost profits, business interruption, or loss of data.
8.3 Nothing in these General Terms and Conditions limits liability in cases where limitation is not permitted by law.
9.1 All intellectual property rights related to materials, designs, content, or products provided by the Supplier remain the exclusive property of GolfJoy Europe B.V.
9.2 The Client may not reproduce, distribute, modify, or exploit such materials without prior written permission.
10.1 The Supplier processes personal data in accordance with the Privacy Policy and the applicable data protection legislation.
10.2 By placing an order, the Client agrees to this processing.
11.1 These General Terms and Conditions are governed by Dutch law.
11.2 Disputes arising from or related to the Agreement shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
12.1 The Supplier reserves the right to modify or update these General Terms and Conditions at any time.
12.2 Changes shall only apply to Agreements concluded after the updated General Terms and Conditions have been published on the website, unless otherwise agreed in writing.
